Terms and Conditions (AGB)

§ 1 Scope of Application

(1) These Terms and Conditions (hereinafter "T&Cs") apply to all contracts concluded via our website www.mensthetic.de and in our business premises between MedPA GmbH, Bleibtreustraße 12, 10623 Berlin (hereinafter "Provider") and our customers (hereinafter "Customer").

(2) The Customer's terms and conditions shall not apply, even if we do not expressly object to their applicability in individual cases.

§ 2 Conclusion of Contract

(1) The presentation of treatments and products on our website does not constitute a legally binding offer, but an invitation to submit an offer.

(2) The treatment contract is concluded only when an appointment is agreed and confirmed by us.

(3) For product orders in the online shop: By clicking the "Buy" button, the Customer submits a binding order. The purchase contract is concluded upon our order confirmation.

§ 3 Treatment Services

(1) The type and scope of the treatment result from the individual treatment plan, which is created after a detailed consultation.

(2) Before each treatment, comprehensive information is provided regarding:

  • Type and scope of the treatment
  • Possible risks and side effects
  • Aftercare and behavioral recommendations
  • Costs of the treatment

(3) By signing the consent form, the Customer confirms that they have been fully informed and agree to the treatment.

§ 4 Prices and Payment Terms

(1) The prices valid at the time of treatment/order apply. All prices are in euros and include statutory VAT.

(2) Payment for treatments is due immediately after the treatment, in cash, by EC card, or by credit card.

(3) For product orders, the following payment methods are available:

  • Credit card (Visa, Mastercard)
  • PayPal
  • Instant bank transfer (Sofortüberweisung)
  • Advance payment (prepayment)

§ 5 Appointments and Cancellations

(1) Agreed treatment appointments are binding.

(2) Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled appointment.

(3) In the event of cancellations within 24 hours before the appointment or no-shows, a cancellation fee of 50% of the agreed treatment costs will be due.

§ 6 Right of Withdrawal for Consumers

(1) Consumers generally have a right of withdrawal for distance contracts.

(2) The right of withdrawal expires in the case of services if the Provider has fully performed the service and has only begun performance after the Customer has given their express consent and at the same time confirmed their knowledge that they lose their right of withdrawal upon full performance by the Provider.

Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform us (MedPA GmbH, Bleibtreustraße 12, 10623 Berlin, email: info@mensthetic.de) by means of a clear statement (e.g., a letter sent by post or email) of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this reimbursement.

§ 7 Warranty and Liability

(1) The statutory warranty rights apply to our services.

(2) The Provider is not liable for the success of treatment. Responses to aesthetic treatments vary individually and cannot be guaranteed.

(3) Claims for damages by the Customer are excluded unless one of the following cases applies:

  • Intent or gross negligence
  • Injury to life, body, or health
  • Breach of essential contractual obligations
  • Liability under the Product Liability Act (Produkthaftungsgesetz)

§ 8 Contraindications and Duties to Cooperate

(1) The Customer is obliged to truthfully inform us prior to treatment about their state of health, existing illnesses, allergies, and the use of medication.

(2) The Customer undertakes to follow the behavioral instructions and aftercare measures provided.

(3) If relevant health information is withheld or instructions are not followed, any liability of the Provider shall be excluded.

§ 9 Data Protection

(1) Personal data are collected and processed in compliance with applicable data protection regulations.

§ 10 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/. Our email address can be found above in the legal notice (Imprint). We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be Berlin.

(3) Should individual provisions of these T&Cs be or become invalid, this shall not affect the validity of the remaining provisions.
